Terms of Service

These Terms of Service ("Terms") govern your access to and use of the DailyTasky mobile application, website, and related services (collectively, the "Service"), provided by DailyTasky ("DailyTasky", "we", "us", or "our").

1. Agreement

These Terms form a binding legal agreement between you and DailyTasky. They apply to every version of the Service, including free and paid tiers, beta features, and any updates we release.

2. Eligibility

You must be at least 13 years old (or 16 in the European Economic Area) to use DailyTasky. By using the Service you represent that you meet this requirement and that you have the legal capacity to enter into these Terms. If you use DailyTasky on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

3. Your account

To use most features of DailyTasky you need to create an account. You agree to:

• Provide accurate and current information when registering.
• Keep your login credentials secure and not share them.
• Be responsible for all activity that occurs under your account.
• Notify us promptly at info@dailytasky.com if you suspect unauthorized access.

4. License to use DailyTasky

Subject to your compliance with these Terms, we grant you a personal, limited, non-exclusive, non-transferable, revocable license to download, install, and use DailyTasky on devices you own or control, solely for your own personal or internal business use.

You may not:

• Copy, modify, distribute, sell, lease, or sublicense any part of the Service.
• Reverse-engineer, decompile, or attempt to extract the source code of the Service, except where expressly permitted by law.
• Use the Service to build a competing product or to scrape or benchmark it without our written consent.
• Remove, obscure, or alter any proprietary notices.

5. Subscriptions & billing

DailyTasky offers a free tier and paid subscription tiers (such as DailyTasky Pro). Paid features are available only while your subscription is active.

5.1 How subscriptions work

• Purchases through Apple App Store or Google Play are charged to your Apple ID or Google account at confirmation of purchase.
• Auto-renewal. Subscriptions automatically renew at the end of each billing period (e.g., monthly or yearly) at the then-current price unless you cancel at least 24 hours before the renewal date.
• Free trials. If we offer a free trial, it converts automatically into a paid subscription when the trial ends, unless you cancel at least 24 hours before the trial's end.
• Price changes. We may change subscription prices from time to time. Price changes take effect at the start of the next billing cycle and we will notify you in advance where required by law. Continued use after the effective date constitutes acceptance of the new price.
• Taxes. Prices displayed may not include applicable taxes, which are determined based on your location and billed by the relevant app store.

5.2 Managing your subscription

You can manage or cancel your subscription in your Apple ID account settings (iOS) or Google Play subscriptions (Android) at any time. We do not process refunds directly for purchases made through the App Store or Google Play — those are handled by Apple or Google according to their policies.

6. Cancellation & refunds

You may cancel a subscription at any time. Cancellation takes effect at the end of your current billing period — you will continue to have access to paid features until then. Unless required by law, we do not refund partial billing periods.

7. Your content

You retain all rights to the tasks, projects, goals, notes, files, and other content you create or upload in DailyTasky ("Your Content"). We do not claim ownership of Your Content.

By using the Service, you grant us a worldwide, royalty-free, limited license to host, store, reproduce, transmit, and display Your Content solely to the extent necessary to operate and improve the Service for you and, where you explicitly choose to share content with others, to those people.

You are solely responsible for Your Content and for ensuring you have the rights to upload and share it.

8. Acceptable use

You agree not to use DailyTasky to:

• Violate any law or infringe anyone's rights.
• Upload or transmit harmful code, malware, or content intended to disrupt the Service.
• Harass, threaten, or harm others.
• Impersonate any person or entity or misrepresent your affiliation.
• Attempt to gain unauthorized access to any account, system, or data.
• Use automated systems (bots, scrapers) to access the Service except via our official APIs, where provided.
• Use the Service to generate content that is sexually explicit involving minors, that promotes self-harm, or that violates our AI providers' usage policies.

9. AI-generated content

DailyTasky includes AI-powered features such as Kora, natural-language task creation, and day planning. These features use large language models provided by third parties.

• AI output may be inaccurate, incomplete, biased, or not suitable for your situation. You should always review and use your own judgment before relying on AI suggestions.
• AI output is not professional advice (legal, medical, financial, or otherwise).
• You are responsible for prompts you submit and for how you use the AI's responses.
• We may apply usage limits or temporarily rate-limit AI features to protect the Service.

10. Third-party services

The Service may integrate with third-party services (such as calendars, authentication providers, and AI providers). Your use of those services is subject to their own terms and privacy policies. We are not responsible for third-party services, and linking to or integrating with them does not imply endorsement.

11. Intellectual property

DailyTasky and its original content, features, code, branding, logos, and design are the exclusive property of DailyTasky and its licensors, protected by copyright, trademark, and other laws. Except for the limited license granted in Section 4, these Terms do not grant you any rights to our trademarks, logos, or other intellectual property.

12. Termination

You may stop using DailyTasky at any time and close your account from Settings → Account or by contacting support.

We may suspend or terminate your access to the Service, with or without notice, if we reasonably believe that you have violated these Terms, created risk or legal exposure for us, or if we discontinue the Service. On termination, your right to use the Service ends immediately. Sections that by their nature should survive (e.g., ownership, disclaimers, limitations of liability, indemnity, governing law) will survive termination.

13. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY OF AI OUTPUTS.

WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE FROM VIRUSES. YOU USE THE SERVICE AT YOUR OWN RISK.

Some jurisdictions do not allow the exclusion of certain warranties, so some of the above exclusions may not apply to you. You may have additional rights under your local law that cannot be waived by these Terms.

14. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL DAILYTASKY, ITS AFFILIATES, OR THEIR OFFICERS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, OR FOR LOST PROFITS, REVENUES, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO YOUR USE OF (OR INABILITY TO USE) THE SERVICE.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) USD $50.

Nothing in these Terms limits liability that cannot be limited by law.

15. Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless DailyTasky from and against any claims, losses, liabilities, damages, and expenses (including reasonable legal fees) arising out of or related to your use of the Service, your violation of these Terms, or your violation of any law or rights of a third party.

16. Apple-specific terms

The following additional terms apply when you download DailyTasky from the Apple App Store:

• These Terms are between you and DailyTasky only, not with Apple. Apple is not responsible for the Service or its contents.
• The license granted to you is limited to a non-transferable license to use DailyTasky on any Apple-branded product that you own or control and as permitted by the Usage Rules in the Apple Media Services Terms and Conditions.
• Apple has no obligation to provide any maintenance or support for DailyTasky.
• If DailyTasky fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price, if any. To the maximum extent permitted by law, Apple will have no other warranty obligation with respect to DailyTasky.
• DailyTasky, and not Apple, is responsible for addressing any claims relating to the Service or your possession or use of the Service, including product liability claims, claims that the Service fails to conform to legal requirements, and consumer protection claims.
• In the event of a third-party claim that DailyTasky or your use of it infringes intellectual property rights, DailyTasky — not Apple — is solely responsible for investigation, defense, settlement, and discharge of that claim.
• Apple and its subsidiaries are third-party beneficiaries of these Terms and, upon your acceptance, will have the right to enforce them against you.
• You represent that you are not located in a country subject to a U.S. Government embargo and are not on any U.S. Government list of prohibited or restricted parties.

17. Governing law & disputes

These Terms are governed by the laws of the jurisdiction in which DailyTasky is established, without regard to conflict-of-laws principles. You and DailyTasky agree to submit to the exclusive jurisdiction of the courts located in that jurisdiction to resolve any dispute arising from these Terms, except that either party may seek injunctive relief in any competent court.

If you are a consumer in the EU, UK, or another jurisdiction that grants you rights to bring proceedings in your local courts, nothing in this section limits those rights.

18. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will notify you by email or through the Service at least 14 days before they take effect (except where a shorter period is required by law or for security reasons). Your continued use of the Service after the effective date constitutes acceptance of the updated Terms.
